General Terms and Conditions of Sale of Products Sold on Bluminart

Article 1 - Purpose

These terms and conditions govern the sales by Bluminart, 66 Avenue des Champs-Élysées, 75008 Paris, of art.

Article 2 - Prices

The prices of our products are indicated in euros, including all taxes (VAT and other applicable taxes as of the order date), unless otherwise indicated and excluding processing and shipping fees.

If you order from a country other than mainland France, you are considered the importer of the products. Customs duties or other local taxes, import duties, or state taxes may be required. These duties and fees are not under the control of Bluminart and will be your responsibility, including the required declarations and payments to the appropriate authorities in your country. We advise you to inquire with your local authorities.

All orders, regardless of their origin, are payable in euros.

Bluminart reserves the right to modify its prices at any time, but the product will be invoiced based on the rate in effect at the time the order is confirmed, subject to availability.

The products remain the property of Bluminart until full payment is received.

Important: Once you physically take possession of the products ordered, the risk of loss or damage is transferred to you.

Bluminart reserves the right to refuse any payment or order confirmation for any reason, particularly in the case of supply issues or difficulties with the received order.

Article 4 - Order Validation

Any order placed on the http://bluminart.com website implies acceptance of these General Terms and Conditions. The confirmation of an order signifies your full and unconditional acceptance of these terms without exception or reservation.

All data provided and the confirmation recorded will serve as proof of the transaction. You declare to have full knowledge of this. The order confirmation will serve as a signature and acceptance of the operations carried out.

A summary of your order information and the General Terms and Conditions will be sent to you in PDF format via the confirmation email.

Article 5 - Payment

Validating your order requires you to pay the indicated price. Payment for your purchases is made by credit card through a secure system. The card is only charged at the time of shipment. In the case of split deliveries, only the products shipped are charged.

Article 6 - Withdrawal

In accordance with Article L.121-21 of the French Consumer Code, you have a 14-day withdrawal period from the date of receipt of your products to exercise your right of withdrawal without having to justify reasons or pay penalties.

Returns must be made in their original condition and complete (packaging, accessories, instructions). Your responsibility is engaged in this case. Any damage to the product may void your right of withdrawal.

Return costs are your responsibility.

In the event of exercising the right of withdrawal, Bluminart will refund the amounts paid within 14 days of the notification of your request, using the same payment method used for the order.

Exceptions to the right of withdrawal:

  • Fully performed services started after the consumer’s express agreement and waiver of their right to withdrawal.
  • Goods or services dependent on market fluctuations.
  • Custom-made or personalized goods.
  • Perishable or quickly expiring goods.
  • Unsealed goods after delivery, for health or hygiene reasons.
  • Goods mixed with others, making them inseparable.
  • Audio/video recordings or software unsealed by the consumer.
  • Newspapers or periodicals, except subscriptions.
  • Digital content not supplied on a physical medium.

Article 7 - Availability

Products are available as long as they are visible on the website http://bluminart.com and subject to stock availability. In case of unavailable products after your order, you will be informed by email, and the order will be automatically canceled with no charge.

Bluminart does not intend to sell large quantities of products, and reserves the right to refuse orders for multiple identical items.

Article 8 - Delivery

Products are delivered to the address provided during the order process, within the timeframe indicated at the time of order confirmation.

In case of delayed shipment, you will be informed by email. If necessary, you have the right to cancel the order in accordance with Article L 138-2 of the Consumer Code. If you receive the product, we will refund it along with shipping costs.

For carrier deliveries, Bluminart cannot be held responsible for delivery delays due to customer unavailability after multiple appointment attempts.

Article 9 - Warranty

All our products benefit from the legal warranty of conformity and hidden defects as provided by Articles 1641 and following of the Civil Code. In case of non-compliance, the product may be returned, exchanged, or refunded. Complaints must be submitted by email within 30 days of delivery.

Article 10 - Liability

Bluminart’s liability is limited to French law compliance. It cannot be held liable for non-compliance with foreign laws.

Article 11 - Governing Law

These terms are governed by French law, and disputes will be handled by French courts.
